Extract registered procuratory of resignation granted by Robert, Earl of Winton, Lord Seton etc whereby on the narrative that afterhe had reached the age of 20 years because of the fragile state of his health and being unable to maintain and govern the noble house of Seton, he constitutes Alexander Inglis of Rottenrow, Henry Wardlaw of Barmule, John Quhyte and David Forrest, each one of them his procurators to compear before his immediate superiors or their commissioners and there to reign the earldom, lands, lordships, baronies, offices, and others particularly after mentioned viz the Earldom of Winton and lands thereof lying within the sheriffdom of Edinburgh and constabulary of Haddington with the dignity and honour of the Earldom with all prerogatives, privileges and liberties; lordship and barony of Seton with castles, towers, fortalices, manors etc advocation of the provostry of the collegiate kirk of Seton and prebendaries thereof and of all other kirks, chaplainries and of offices of parish clerkships thereof; and the lands and barony of Tranent with castles, towers, fortalices, manors etc advocation, donation and right of patronage of kirks, colleges and prebendaries, chaplainries and offices of parish clerkships; the lands and baronies of Easter and Wester Barns with their pertinents; the lands and barony of West Nudry with the lands and barony of Winchburgh and lands of Upcragis specially annexed thereto with castles, towers, fortalices, manors etc united and annexed into a hail free barony called the barony of West Nudry lying within the sheriffdom of Linlithgow; the lands of Hartsyde Clintis, lying within the sheriffdom of Berwick; the town and mains of Kirkliston, and the town and lands of Lasswade; the kirklands of Lasswade and the lands of Eglismachane with the coal heughs thereof lying within the regality of St Andrews and sheriffdoms of Edinburgh and Linlithgow respectively; the office of justiciary general of all courts and justice ayres within the regality of St Andrews upon the south side of the Water of the Forth, to wit, of the lands and barony of Kirkliston etc with all other lands, baronies, lordships, towns, cities and villages wherever they lie within the realm of Scotland, upon the south side of the Water of Forth, lying within the sheriffdoms of Stirling, Edinburgh and Linlithgowand constabulary of Haddington foresaid or other sheriffdoms whatever within the bounds respective foresaid and siclike the offices of bailliary and stewartry of the barony of Kirkliston and lands above specified; the temple lands lying within the lordships and barony of Seton, Winton, Tranent, Winchburgh, Uperagis, Westnudre, Duddingston; and all other lands heritages annualrents to which he might claim right of succession to his unquhile father of goodsire or any of his predecessors holden of whatsoever superiors in blench, ward and relief or feu farm with all other offices if any be in the hands of his immediate superiors in favour of George, Master of Winton, his brother german and the heirs male lawfully to be gotten of his body which failing to Sir Alexander Seton of [ ], also his brother german and the heirs male lawfully gotten of his body, which failing to Thomas Seton of [ ], also his brother german and the heirs male lawfully gotten of his body, which failing to John Seton of [ ], also his brother german, and the heirs male lawfully gotten of his body, which all failing to the nearest and lawful heirs male mentioned in the infeftment of the lordship of Seton, lately erected in an earldom, called the Earldom of Winton, bearing the name badge and arms of the House of Seton, providing always that immediately after the said George, Master of Winton should be infeft and seased in the earldom, lordships, baronies etc he should be interdicted from all alienation thereof, without the special advice, counsel and consent of Alexander, Earl of Dunfemline, James, Earl of Abercorn, James, Lord of Balmerinno, Sir William Seton of Kylismure, and Sir Thomas Hamilton of Monkland, the King's advocate or the most part of them being in life, and failing of them or any of them by decease by the advice of the nearest of kin, who have right to succeed being of perfect age, (said Alexander, Earl of Dunfermline always being one), first had and obtained thereto, otherwise that present letter of procuratory and resignation and all infeftments following thereupon to be null, and also that George, Master of Winton be bound and obliged to reverence and honour me as older brother and sustain me in all my necessities Dated at Seton Recorded in the Books of Council and Session, 25th July thereafter |
