Description |
Of the lands of Haywardis of Ballindoche - except for an acre thereof reserved to the said Lord Ogiluy - for 400 merks Scots. Dunde, 6 June 1508. [Seal appended]. Instrument of consignation whereby James, Lord Ogylwy, deposited the sum of 400 merks Scots in a box on the altar of St.Paul within the parish church of Dunde, for redemption of the said lands until such time as the said Lord receive the letter of reversion pertaining thereto; which letter the said John alleged had been given to Andrew, Lord Legray, by order of the said Lord Ogylwy. 10 November 1509. Instrument of consignation narrating that James, Lord Ogilwy, and John Ogilby, uncle to said Lord on his mother's side, compeared in the parish church of Dunde where said Lord gave to said John the sum of 400 merks Scots in redemption of the lands of Halzardis otherwise Bandoch, in terms of the aforesaid reversion; which reversion the said Lord required the said John to show but the latter asserted that by order of said Lord he had given the same to Andrew, Lord Legray. which said Lord Ogilwy denied; whereupon, in presence of said John and notaries, the said Lord counted the said 400 merks and shut them in a box which he placed upon St.Paul's altar in the said church; but said John refused to accept this as a suitable place whereupon the said Lord opened the box and placed the money in the communal chest belonging to the burgh of Dunde in the porch of said church. 10 November 1509. Instrument of resignation ad remanentiam by Helen Cosowre, spouse and executrix of deceased John Ogilwy of Halzardis, with consent of Gilbert Menzeis, provost of Aberdeen and John Mar, bailie of the same, to James, Lord Ogilwy, of lands of Halzardis, with provisions relating to payment of monies due by said John Ogilwy.
