Title |
I. Instrument under the hand of Henry Myln, Master of Arts, of the diocese of Brechin, notary public, narrating that Edward Bowquhannane, son of Walter Bowquhanane, in presence of the notary and witnesses, passed to the parish church of Killern in the diocese of Glasgow and to the houses of the parishioners of said parish one by one, and that the whole of the parishioners (gentlemen, husbandmen and tenants) declared that the office of clerkship of said church was vacant by the pure and simple demission of Walter Bowquhannane, the last clerk, and was in their gift by public election [et ad eorum donationem per eorum communem electionem]; they thereupon, with joint consent and assent, publicly and viva voce, no one dissenting, elected the said Edward as their parish clerk, giving him their voices for the said clerkship and office with the fruits and rights thereof for the whole time of his life; he, either by himself or a suitable substitute, performing at the parish church and in the parish the services used and wont. Done in the said church and parish at the hours of 11 and 12 forenoon and 5 afternoon of the 29th day of August 1531. II. Letters by Gavin, archbishop of Glasgow, narrating that a suit was pending before his court between Edward Buchquhannane, tonsured clerk, on the one part, and Sir John Napar, presbyter of the diocese of Glasgow, and others, parishioners of Kyllerne (lawfully cited by public edict) on the other part, regarding the validity of the election of the said Edward to the parish clerkship of Kyllerne; that at the term assigned for hearing objections the said Sir John Napar compeared in the chapter of the archbishop's church of Glasgow, but produced no reasonable cause either by word or writing to impede the premises; that on Sir John's request for a new hearing, the archbishop assigned the 13th of September, and in the event of his absence, he appointed Mr. John Spreull, vicar of Dundonald, his judge and commissary in the cause; that on the said date the archbishop being absent in Edinburgh on the business of the chancellorship, Sir John compeared in presence of the commissary, but again failed to produce in writing his reasons why the said election should not be confirmed, alleging that they were not ready through the fault of Sir John Morisoun, his procurator, who was absent from the city; that the commissary further prorogued the hearing to the 15th of September, on which day Sir John compeared before him and produced reasons to hinder the confirmation of said election; that on the said reasons being considered the commissary pronounced and declared them invalid according to law, and decerned Sir John liable in expenses, reserving the taxation thereof; all as set forth in the public acts under the hand of Mr. Andrew Smyth, dean of Christianity of Lennox, notary public, depute clerk to the said commissary; the archbishop, therefore, approved, ratified and confirmed the said election and the preceding instrument, and commanded the dean of christianity of Lennox, the curate of the church of Kyllerne, and others, or any one of them, when required to go to the said church and induct the said Edward Buchquhannane to the clerkship of the said parish and the rights and pertinents of the same by delivery of the water-stock and sprinkler, and to cause the fruits and emoluments of his office to be rendered to him.
