Title |
Disposition and Assignation by John Forrester of Braes, writer in Edinburgh, factor for Andrew Young, joiner in London, brother and executor of Elizabeth Young, daughter of Robert Young of Drumaliart, which narrates No. GD86/946, and in consideration of the sum of £61:17: 6 Stg. received from Sir James Stirling of Glorat, as the said Andrew Young's proportion of the purchase price of the estate, dispones to Sir James as a collateral security of his purchase the decreet of adjudication No. 5 infra. The said Andrew Young's claim was founded on the following writs: (1) Contract (dated 15 July 1726 and registered in the Sheriff Court Books for Stirlingshire 18 June 1731) between John Young of Drumaliart and Margaret Gillespie, his mother; (2) Assignation (dated 18 April 1734) by Margaret Gillespie to Elizabeth Young; (3) Letters of Inhibition (dated 27th and registered in the P. R. I. at Stirling 29th April 1734) raised at the instance of Elizabeth Young against John Young; (4) Decreet of the Sheriff of Edinburgh (dated 16 February 1739) obtained by Elizabeth Young against John Young; (5) Decreet of Adjudication (dated 12 June and recorded 19 July 1739) of the Lords of Session obtained by Elizabeth Young against John Young; (6) Decreet of the Sheriff Substitute of Stirling (dated 25 July 1755) obtained by Andrew Young as executor foresaid against Robert Young, sometime tenant in Wester Strath thereafter in Summer House, husband of the said Elizabeth Young; (7) Testament of Elizabeth Young confirmed by the commissary of Edinburgh on 5 March 1756; and (8) Factory (dated 21 June and registered in the Sheriff Court Books of Stirlingshire 9 November 1753) by Andrew Young in favour of the granter.
