Title |
Disposition and Assignation by John Gillespie, wright in Calton of Glasgow, eldest son of Robert Gillespie, maltman in Falkirk, brother and heir of Elizabeth and Mary Gillespie, indwellers there, and creditor of the deceased John Young of Drumaliart, which narrates No. GD86/946, and in consideration of the sum of £56 Sterling paid to him by John Forrester, writer in Edinburgh, trustee on Young's estate, dispones to Sir James Stirling of Glorat, as a collateral security of his purchase of the debtor's lands, the decreet of adjudication No. 7 infra: The granter's claim was founded on the following writs: (1) Bill of Exchange (dated 29th November 1733) for 350 merks Scots drawn by the said Mary and Elizabeth Gillespie on and accepted by Young and endorsed to Elizabeth Young, his sister, with protest and letters of horning following thereon: (2) Account, signed by Young, due to the said Robert Gillespie for £36:16: - Scots; (3) Assignation by Gillespie to the said Elizabeth Young; (4) Contract between the said John Young and Margaret Gillespie, his mother, which provides for the division of 700 merks between Robert Young and the said Elizabeth Young, her children; (5) Assignation by Margaret Gillespie to Elizabeth Young of the said contract; (6) Letters of Inhibition obtained by Elizabeth Young against her brother, John, recorded at Stirling 29th April 1734; (7) Decreet of Adjudication (dated 12 June 1739) obtained before the Lords of Session by her against him, adjudging his lands of Drumaliart; (8) Back Bond by Elizabeth Young to Robert, Mary and Elizabeth Gillespie, relative to Nos. GD86/1 and 2 and to a Decreet obtained at her instance before the sheriff of Edinburgh against her brother for payment of 350 merks; and (8) Extract Disposition and Assignation (dated 20 January 1763) by Robert Gillespie for himself and as heir to Mary and Elizabeth, his sisters, to the granter of the said bill, account etc. and of two General Retours in his favour as heir to his sisters, dated 18th March 1763.
