Title |
Disposition and Assignation by John Watson, writer in Edinburgh, creditor of the deceased John Young of Drummaliart, which narrates No. GD86/946, and in consideration of the sum of £8:4:10 paid to him by John Forrester, writer in Edinburgh, trustee on Young's estate, dispones to Sir James Stirling of Glorat, as a collateral security of his purchase of the debtor's lands, the Decreet of Adjudication No. 4 Infra His claim was founded on the following writs: (1) Bill of Exchange for £9 Stg. (dated 26th June 1734) drawn by Alexander Johnston, merchant, Leith, on and accepted by Young; (2) Decreet (dated 10th March 1737) obtained before the sheriff of Edinburgh by Johnston against Young for £5:15: 2; (3) Assignation (dated 12th January 1739) by Christian Hopekirk, relict of John Strachan, writer in Edinburgh, executor dative qua nearest in kin to Alexander Johnston, her uncle, to the granter of said decreet; (4) Decreet of Adjudication (dated 24 February 1739) obtained before the Lords of Session by the granter against Young, with abbreviate thereof recorded 21 April 1739; and (5) Letters of Horning, with execution against Captain John Stirling of Herbertshire, superior of the debtor's lands, dated 4 September 1750.
