Title |
Disposition and Assignation by James Dallas, writer in Edinburgh, factor for Elizabeth MacDowal alias Baird, relict of Thomas Baird, wright in Edinburgh, creditor of the deceased John Young of Drummaliart (conform to Factory dated 7th and registered in the Sheriff Court Books of Edinburgh 8th September 1764) which narrates the Submission and Decreet Arbitral No. GD86/946, and in consideration of the sum of £22:19:- paid by John Forrester, trustee on the estate of the said John Young, dispones to Sir James Stirling of Glorat, as a collateral security of his purchase of the debtor's lands, writs Nos. 1 to 4 Infra. The said Elizabeth MacDowal's right was founded on the following writs viz:- (1) Decreet of proving the tenor (dated 8th December 1757) obtained before the Court of Session by John Kennedy, surgeon in Edinburgh, against [ ] Young, eldest son of the late Robert Young, brother of the said John Young, and Andrew Young, carpenter in London, also his brother; (2) Decreet of Adjudication (dated 20th December 1738) obtained by Kennedy against Young, with Abbreviate thereof, registered 25th January 1739; (3) Letters of Horning executed against William Stirling of Herbertshire, superior of the lands of Drummaliart, dated 17th January 1740; (4) Account of Expenses for said decree and letters; (5) Extract Disposition of No. 2 by Kennedy to himself and his heirs, whom failing to Cessford Baird, his nephew, dated 14th November 1751, and registered in the Sheriff Court Books of Edinburgh 1 December 1760; (6) General Retour of the said Thomas Baird, as heir of provision of the said John Kennedy, his uncle, dated 24 June 1761; and (7) Disposition by Baird to his wife of No. GD86/2, dated 12th April and registered in said Sheriff Court Books 7th July 1764.
