Title |
Disposition and Assignation by Thomas Turnbull, son of John Turnbull, maltman in Stirling, creditor of the deceased John Young of Drummaliart, which narrates the terms of Submission and Decreet Arbitral No. GD86/946, and in consideration of the sum of £15:14:11½ Stg. paid to him by John Forrester, writer in Edinburgh, the trustee on Young's estate, being his share under the Scheme of Division, dispones to Sir James Stirling of Glorat, as a collateral security of his purchase of the debtor's lands, the annualrent of the principal sum of £55 Stg. contained in bond of corroboration aftermentioned from 27 August 1735 to 26 April 1744 the date of death of Christian Turnbull, aftermentioned: The granter's claim was founded on the following writs:- (1) Bond of Corroboration (dated 27th August 1735, and registered in the Sheriff Court Books of Edinburgh 20th October 1738) for £55 Stg. by the said John Young to John Brown, tailor in the Cannogate; (2) Disposition (dated 9th July and registered in the Burgh Court Books of Edinburgh 24th September 1741) by the said John Brown to John Cleland, merchant in Edinburgh, and other trustees; (3) Disposition and Assignation (dated 22 December 1743 and recorded in the Burgh Court Books of Edinburgh 11th December 1755) by Christian Turnbull, widow of the said John Brown, to the foresaid John Turnbull, her brother; and (4) Extract Disposition and Settlement by the said John Turnbull, dated 21st March 1761 and registered in the Burgh Court Books of Stirling 8th January 1762.
