Title |
Extract from the Books of Council and Session of Disposition by Mr. John Steel, minister at Stair, with consent of Mary Chalmer, his spouse, whereby, in consideration of the sum of £1,833: 6: 8 Stg. paid to them by Andrew Chalmer, writer in Edinburgh, on behalf of John, Earl of Cassillis, they disponed to the Earl an annualrent of £83: 6: 8 Stg., being one-third part of the annualrent of £250 constituted by GD86/912, 914; to which annualrent the said Mary Chalmer acquired right by the following deeds viz:- (1) Retour of Special Service in her favour as one of the heirs portioners to Captain John Chalmer, her brother; (2) Bond granted by her to Kenneth Williamson, writer in Edinburgh, for £7000 Stg., dated 11th and registered in the Books of Council and Session 20th June 1748; (3) Letters under the Signet in virtue of which Williamson charged her to enter heir in special to her brother; (4) Decreet of Adjudication following thereupon, dated 23 November and 2 December 1748; (5) Back Bond granted by Williamson to her, dated 11 June 1748 and registered in the Books of Council and Session 24 July 1749; and (6) Disposition in her favour of the said Decreet of Adjudication, dated 3 August 1749 and registered in the Books of Council and Session 14 November 1750: with procuratory of resignation and precept of sasine. Ratification by the said Mary Chalmer, outwith the presence of her husband and in presence of John Hunter of Brownhill, Justice of Peace for Ayrshire, of the above deed. Instruments taken in the hands of Robert Paterson, N.P., by James Key, wright in Ayr, attorney for the Earl.
Registered 31 July 1752. Certified by Tho. Gibson. There is a note endorsed on the Extract to the effect that Mrs. Steel was along with her two sisters infeft in virtue of a Precept of Clare Constat from Sir David Cuningham. |
