Title |
Instrument of Sasine under the hand of James Fergusson, clerk, of the diocese of Glasgow, notary public, following upon and narrating the precept of sasine in a heritable bond (dated at Livingstoun 12th August 1740) by Sir James Cuninghame of Milncraig, whereby, in compliance with a judgment of the House of Lords and the procedure of the Court of Session following thereupon, he bound and obliged himself (1) to pay to Captain John Chalmer of Gaitgirth the sum of £43,777: 6: 8d. whenever the latter should purge the lands and estate purchased by Sir David Cuninghame of Milncraig of the debt and adjudication following thereon at the instance of William Chalmer, second son of the deceased John Chalmer of Gaitgirth, against John Chalmer of Gaitgarth, his brother, and of three fifths of the debt and adjudication thereon at the instance of Mary Chalmer, daughter of the deceased John Chalmer of Gaitgirth, against the said John C. of Gaitgirth, her brother, and (2) to pay the interest on the said capital sum until it should appear to the Lords of Session that Captain Chalmer had so purged the same; and in security thereof he bound and obliged himself to infeft Captain Chalmer in the lands and barony of Martnaham, with the lands of Bow, Bogside, Windyhill and Pettoch lying in Kings Kyle and sheriffdom of Ayr, the forty shilling land of old extent of Deuchrays called Newlands, Corshill, Harriestoun, the seven merkland of Minnihaigen and Rankinestoun, lying in the parish of Coyletoun, King's Kyle and sheriffdom foresaid.
