Title |
Indenture (in vernacular) between Robert, Duke of Albanie, Earl of Fyff and Mentetht, Governor of Scotland, and John Stewart, Earl of Bouchane, Chamberlain of Scotland, his son, on the one part, and Sir Archibald, Earl of Douglas, Lord of Galway and Anandirdale, on the other part, for the marriage of the Earl of Bouchane to Elisabeth of Douglas, daughter of the Earl of Douglas. |

Description |
The parties were to send to the Pope "message with al gudly haist for the purchesse of the said mariage to be fulfillit", and the Earl of Douglas was to give heritably, before the fulfilment of the marriage, 200 merks worth of land in property and demesne with the tenandries, if any (viz: the lands of the Stewarton and Ormysheucht with pertinents in the barony of Cunyngaham and sheriffdom of Are) to the Earl of Bouchane and Elisabeth, and to the longer liver of them and to the lawful heirs to be "gottin" between them, whom failing, to the lawful heirs male of the body of the Earl of Bouchane, whom failing, to return to the Earl of Douglas and his lawful heirs "qwhat ever thai be". The Earl of Douglas obliges himself, if the foresaid lands of Stewarton and Ormysheucht do not extend to 200 merks of ferm yearly, to give as much land, under the same form and condition of tailzie as he is obliged to give the former, lying "in swilkconuable place as the forsaid lord the duc haldis him content of", and also, after the "purches" for the marriage arrives in Scotland and before the fulfilment thereof, to resign the said lands into the hands of his overlords in favour of the spouses. Further, the Earl of Douglas obliges himself, in the event of his wife surviving him and claiming her joint infeftment in the lands of Stewarton and Ormysheucht, to pay to the spouses, as long as his wife enjoys that right, as much annualrent from his four baronies of Bothvile, Strathawane, Drumsargart and Curmannok as the ferm of the former lands extends to at the fulfilment of the marriage, but if he procures from her a quitclaim of her joint infeftment of the said lands with "lettre of witnessing" in favour of the spouses, he is to be quit of his obligation to pay annualrent from his four baronies. The Earl of Bouchane is to give to Elisabeth as dowry in liferent before the fulfilment of the marriage 200 merks worth of land of free rent yearly lying in "conuable and esy place with charter witnes and lef of the ourlord". Douglas and Bouchane gave their bodily oaths upon the holy evangels to fulfil and keep the premises. The Indenture is attested by appending the seals of the Lord Governor and Bouchane to the Earl of Douglas's copy and of Douglas's seal to the other copy. At Perth 21 July 1410 This is apparently the copy of the Lord Governor and his son as only one seal (gone) has been attached. |
