Title |
Information for Catharine, Mistress of Rollo, and Androw, Master of Rollo, her husband, for his interest, against John Farghurson of Invercauld. The deceased Lord James Murray left three daughters, Margaret, Catharine and Anna. Invercauld married Margaret, the eldest, with whom he got 20,000 merks of tocher, which he accepted in full satisfaction of all he could claim through her father's decease or her parents contract of marriage, etc. On the death of Anna, the youngest daughter, Invercauld in name of his children claimed an equal share with Catharine in her estate and eventually accepted 7000 merks in full satisfaction of the claim. Before her death Anna expressed a wish to mortifie the sum of 5000 merks for pious uses, and in order to give effect thereto her sister Catharine, before the conclusion of the Articles of Marriage with the Master of Rollo, did denude herself of debt in favour of John Mercer, Writer in Perth, who gave his back bond to advance the sum of 5000 merks to be applied and mortified to pious uses at the sight of her friends. Invercauld, as administrator for his eldest son, claims that one-half of the above sum should be applied to pious uses within the parish where he resides and threatens to raise a law suit if his request be disallowed.
