Title |
Letters of Horning under the Signet of Queen Anne charging Elisabeth Maxwell, relict of Robert Maxwell of Kirkhouse, and only daughter and heir procreated of the marriage between John Maxwell of Gelstoune, brother-german of Lord Herries, and Elisabeth Glendoning, his spouse, to implement her Ratification (dated 9th February 1705), ratifying and confirming (1) a contract (dated 5th April 1704 and registered in the Books of Council and Session 15th May 1704) entered into between her parents, on the one part, and Robert Johnstoune of Kelltoune, on the other part, whereby the former bound and obliged themselves to deliver to the latter a valid disposition of (a) the 8 merkland of Boardland, the 3 merkland of Whytehill, the 20 shilling land of Newlands, the 3 merklands of Meikle Inglistoune, the 3 merkland of Craigley and the 3 merkland of Westquarter, Summershiells and Soottiecroft, with the teinds, parsonage and vicarage, thereof, lying in the barony of Gellstoune and stewartry of Kirkcudbright; (b) the miln of Gellstoune with the houses and milnlands thereof and the astricted multures and sequels of the said barony (comprehending therein the 7½ merkland of Airieland, the lands of Glenholl, Kirmirran, Glenyearrow, Wood, Little Inglistoune, Porterland and Killdow, extending to a 20 merkland); and (c) the heritable office of baillie of said barony; and (2) contract entered into between William, Earl of Nithisdale, and the said Robert Johnstoune: At Edinburgh 21st February 1705 a. r. 3 |

Put up with principal Letters (1) Certificate of execution by John Martine, messenger, of said Letters of Horning, dated 4th July 1705: Witnesses, William Herriot and David Aikenhead, commissary officers of Dumfreis, and William Gordoune, writer, Dumfries; and (2) Certificate by Alexander Thomson, messenger, certifying that on 19th July 1705 he denounced the said Elisabeth Maxwell rebell at the market cross of Edinburgh: Witnesses, Robert Wilsone and George Gilchrist, messengers in Edinburgh.
