Title |
Instrument of Sasine under the hand of Patrick Scott, clerk, of the diocese of Brechin, notary public, following upon and narrating a charter of resignation under the great seal (dated 14th September 1703) granting to James, Lord Fincastle, lawful eldest son of Charles, Earl of Dunmore (1) the lands and barony of Livingstoun lying in the sheriffdom of Linlithgow and (2) the templelands of Newyeardfield and others all as described in No. GD86/808; reserving, in terms of the contract of marriage (dated 29 September 1702) entered into between Lord Fincastle (therein designed Lord Blair) and Jonet, Lady Fincastle (therein designed Jonet Murray, daughter of Patrick Murray of Livingstoun) to Jonet Hepburn, relict of the said Patrick Murray, her liferent in said lands provided under her marriage contract and providing that, failing heirs of his marriage with the said Jonet, Lord Fincastle was to be repaid the 40,000 merks Scots paid by his father in view of his marriage, and 60,000 merks provided by the said Patrick Murray; but in the event of there being heirs female who should succeed to the said Patrick Murray only the 40,000 merks provided by the Earl of Dunmore was to be repaid: which lands formerly pertained heritably to the said Patrick Murray and were resigned by him, in virtue of the procuratory of resignation contained in said marriage contract, into the hands of the commissioners of Treasury and Exchequer in favour of Lord Fincastle. Sasine given of said lands on 15th October 1703, at the Peel of Livingstoun by James Carmichael of Poddingshaw, sheriff of Linlithgow in that part, to Lord Fincastle |

Witnesses to the charter under the Great Seal same as in No. GD86/815. Witnesses to the sasine, Mr. John Murray and Mr. Robert Murray, sons of the said Earl of Dunmore, and James Stewart and Walter Mortoun, servitors of Lord Fincastle.
