Title |
Charter of Sale (undated and unsigned) by James, Viscount of Stair, and John, Master of Stair, his son, in favour of James Cunynghame, of subjects in the parish of Dalmellington in the sheriffdom of Air. The charter is almost wholly indecipherable, but so far as it can be read it agrees with the terms of the charter (dated at Stair 1 May 1694) on which an Instrument of Sasine (dated 15 May and registered P.R.S. Ayr 2 June 1694) in favour of James Cunyngham, lawful eldest son of Mr. David Cunyngham of Milnecraig, advocate, and grandson of the Viscount, proceeds (Vol. VI, pt. I, fol. 101). The subjects, for which the consideration was £500 Scots, are described in the sasine as follows:- (1) the 7 merklands of Dalmellington, comprehending the two merklands of Dalfarsan, the merkland of Achmadie and Gaitsyde, the two merklands of Over Pennyarthour and the 2 merklands of Glenmuck, with the mill of Dalfarsan, mill lands, multures, etc., and (2) those houses, tenements and yards in the town of Dalmellinton, which formerly pertained to the late David Crawfurd of Kers and afterwards to the late Alexander Crawfurd of Kers, as more particularly bounded in the ancient infeftments, all lying in the parish of Dalmellinton, Kyle Regis and sheriffdom of Air: which lands were lawfully adjudicated at the instance of the said Mr. David Cunyngham from Alexander Craufurd of Kers, son of and commanded to enter heir in special to the said Alexander Crawfurd, his father, in virtue of a decreet of adjudication (dated 6 February 1694) obtained from the lords of Council and Session against the said Alexander Crawfurd for payment of the sum of £10217:6:10 Scots of principal, annualrent and liquidate expenses; and to which decreet the said James Cunyngham acquired right by disposition and assignation from his father dated 8th March 1694 |
