Title |
Instrument under the hand of Mr. John Chepman of the diocese of Glasgow, notary public, narrating letters under the Signet (dated at Edinburgh 21 November a.r.2, 1514) addressed to the Snawdoun, Ross and Yla heralds, Charles Campbell, macer, Unicorne, Carrik, Marche and Garriach pursuivants, Johnne Adamsoun, Duncan Richardsoun, James Bissate, David Cameron and David Lowry, messengers, sheriffs in that part, directing them to "mak" Marioun Levingstoun, sister and one of the heirs of umquhile Mr. Barthilmew Levingstoun of that Ilk, "to ken" her terce and third part of the lands and barony of Levingstoun, with tenant, tenandry and service of free tenants thereof, lying in the sheriffdom of Linlichqw, to which she was served and retoured before the sheriff of Linlichqw, and in which she was infeft two years ago or thereby in terms of Precept from Chancery directed to the said sheriff, but who nevertheless "kend nocht the said Marion to samekill as he gafe hir state of becaus he had the eldest sister son with his ward and mariage as is allegit". Further narrating that after the reading of the said letters the said David Lowry caused the said Marioun to cast lots for her part and portion of her brother's lands, and the other two co-heiresses having obtained the first and second lots, the third lot fell to the said Marioun: whereupon the said David passed in the first place to the houses of the Mains of the barony of Levingstoun (viz:- to the town commonly called the Kirktoun of Levingston) and there, beginning at the east end thereof and going westwards with the sun and without considering (relictis) the parts and portions of the said two co-heiresses, he assigned, marked and pointed out the third part (viz:- the couple "Ane lady havand the tierce of ony landis pertening to hir aucht and sould have also the thrid part of the barn zaird, and the thrid part or cupple of the barn to be usit be hir for labouring and manuring of hir tierce; and the schiref of the schire sould ken hir to hir thrid part thairof be ane brief of divisioun gif scho pleis to rais ony thairupon, or be ony uther way conform to the lawis of this realme [Balfour's Practicks - Edin. 1754 - p.106]. (compages) commonly called the "thrid cuppill") of the houses of the said Kirktoun of Levingstoun to the said Marioun, viz:- a couple in the east side of the chamber which John Wallace alias Smyth holds and inhabits, a couple in the east side thereof, a couple in the east side of the stable occupied by Lawrence Heg alias Cuke, a couple in the west side thereof a couple in the east side of the house occupied by Jonet Stevin, a couple in the west side thereof, a couple in the east side of the house held and occupied by John Mureheid, the stable thereof, a couple in the middle house which James Gray inhabits, a middle couple in the house occupied by the said James, a couple in the west side of the chamber which Jonet Stele occupies, a couple in the middle house which Thomas Ker holds lying in the foresaid Kirktoun of Levingstoun, a couple in the south side of the Mill of Levingstoun and one in the north side thereof, a couple in the middle house which Robert Hardy inhabits, a middle couple in the byre (bostarium) which Helen Douglas occupies, a couple in the east side of the hen-house occupied by the said Jonet [Stele], a middle couple in the barn occupied by her near the manor of the said place of Levingstoun, a middle couple in the house which Robert Thomsoun inhabits and a couple in another house occupied by him: finally the said David Lowry passed to the "riggis" of the said Mains of Levingstoun and there in terms of said royal letter assigned, marked and pointed out the third rig (porea), with all its profits, emoluments and pertinents, to the said Marioun, whose part of the rigs on the authority of the husbandmen who counted them, extends to nine score and six rigs with a third part of two rigs.
