Title |
Declaration by George Stirling of Harbertshyre, narrating that by decreet (dated 21 April 1684) the commissioners appointed by King Charles II for division amongst the creditors of Archibald late Marquess of Argyll and Archibald, late Earl of Argyll, of the estate of Argyll, which fell into the king's hands by the forfeiture of the said Earl on - December 1681, did allocate to him (1) the superiority of (a) the lands of Balwill, extending to a 5 merkland of old extent, with manor-place etc. (b) the lands of Woodend with the wood thereof, etc. (c) the lands of Over and Nether Ballairds, with the myln of Ballairds etc. all lying within the parish of Drymen, barony of Gleneigles and sheriffdom of Perth, and (d) the lands of Kepdaurie lying within the said barony and sheriffdom, and (2) a feuduty of £40 Scots furth of the foresaid lands, and that by disposition (dated 24 February 1687) Sir William Patersone, clerk of the Privy Council, Sir David Thoires, advocate, and George McKenzie, one of the clerks of Exchequer, trustees to whom the estate of Argyll was disponed for behoof of creditors, disponed to him the said superiority and feuduty which were resigned into the hands of the commissioners of Thesaurie and Exchequer in favour of himself and his foresaids: nevertheless he declares that the infeftment to be expede following said resignation shall be taken to himself and his heirs male, whom failing, to his heirs and assignees whomsoever, under reservation to Jean Murray, his spouse, of an annualrent of 1000 merks furth of the lands above described.
