Title |
Instrument of Sasine under the hand of William Calderwood, clerk, of the diocese of Edinburgh, notary public, following upon and narrating a precept of sasine in a bond of provision (dated at Edinburgh 11th August, 1682) by James Balleny, portioner in Gilmertoune and indweller in the Newtoune of Shirrifhall, whereby he bound and obliged himself to infeft Beatrix Baxter, his spouse, in liferent in (1) that tenement of land, houses and yard with the well belonging thereto at the east end of the town of Gilmertoune (sometime possessed by James Richman, smith, and now by Margaret Young, relict of David Balleny) between the common green on the south, "the gootter that comes from the closs presently possessed be William Matthe as it comes foranent the gavell of that hous belonging to the said William Matthe, his tenement", and presently possessed by himself, on the west, the high street that leads from Edinburgh to Newbottle, on the east, and the high street that leads from the foresaid high street, to the houses possessed by Ronald Richardsone and the dwelling house possessed by Alexander Richardsone, on the north, (2) that piece of ground on the said high street between the gavell of the smiddy presently possessed by the said Alexander Richardsone and the door cheeks of the house presently belonging to Johne Clerk on the south and north, the yard belonging to them on the east, and the said high street on the west, and (3) that piece of ground comprehending 40 feet taken off the common green of Gilmertoune "eastward from the said David Balleny his yard dyck and now added to his yard as it now stands and from his well westward so far as the said yard dyck doeth extend and that for enlarging of his said yard and building ane barne thairupon quhich is now builded", all pertaining to him and lying within the parish of Libertoune and sheriffdom of Edinburgh. Witnesses to the bond of provision, Williame Cockburne and Williame Anslie, messengers in Edinburgh, Johne Banzie, macer of the Criminal Court, Patrick Foreman, servitor to the Lord Advocate, and Johne Browne, brewer in Edinburgh. Witnesses to the sasine, Williame Hunter in Kaimend of Shirrifhall, Williame Balleny there, Williame Haigs, smith there, Thomas Warruck, bailie in Gilmertoune, Thomas Gray, cordiner there and David Baird, tailziour there.
The granter of the bond of provision who can only write his initials, subscribes with his hand at the pen led by William Calderwood and Thomas Williamsone, notaries public.
