Title |
Extract of Decreet or Removing pronounced by John Keirie of Gogar, one of the deputes of Charles, Earl of Mar, sheriff principal of the sheriffdom of Sterling, in the action of removing at the instance of George Stirling of Herbertshyre against James Robertsone in Gunnershaw, decerning the latter to flit and remove from the lands of Gunnershaw, mill, mill lands, etc. thereof at Whitsunday 1682. For instructing the libel the pursuer produced (1) precept of warning with the execution thereof (2) charter under the testimony of the Great Seal (dated 7th February 1654) in favour of William Stirling of Herbertshyre of the lands and barony of Herbertshyre, (3) Instrument of Sasine Vol. XL, fol. 327 (dated 8th and registered G.R.S. Edinburgh 12th April 1678) under the hand of John Grahame, notary public, following upon a disposition by the said William Stirling to the pursuer of said lands and barony, and (4) Instrument of Sasine Vol. V fol. 361 (dated 3rd and registered P.R.S. Stirling 20th April 1677) under the hand of William Rind, notary public, following upon a charter of resignation relative to a disposition by James Broun, merchant, Sterling, to the pursuer of the said lands of Gunnershaw with the mill and mill lands thereof etc., lying in the parish of Duneypace, barony of Herbertshyre and sheriffdom of Sterling, to which the said James Broun acquired right through an apprising led by him against the deceased James, Lord Forrester and others. The decree was pronounced in a court of the sheriffdom of Sterling held in the Tolbooth of the same on 16 June 1682 |
