Title |
Petition by George Stirleing of Harbertshyre to the Lords of Council and Session, praying to have an interlocutor pronounced in the action raised at the instance of John McPharland, W.S., executor of John McPharland in Doune, against him for reduction and improbation of his right to the lands of Harbertshyre reconsidered and the extract of the act, which was unwarrantably extracted, rectified: The Petition narrates that umquhile William Stirleing, the petitioner's brother, was bound as co-cautioner with his father to pay for Sir John Hadden of Glenagies to the said umquhile John McPharland the sum of 700 merks of principal which his said executor had confirmed and thereupon raised the said action; in which their lordships sustained the petitioners defence that the bond was null because granted by a minor who was not lawfully authorised to do so by his father and his tutor and curator but the clerk to the proces during the vacancy entrusted the extracting of the act to a servant who did so contrary to the terms of the interlocutor |
