Title |
Instrument of sasine under the hand of John Jaffrey, clerk, of the diocese of Aberdeen, notary public, following upon and narrating the precept of sasine in a charter (dated at Edinburgh 10 April 1676) by Sir John Baird of Newbyth, knight, one of the Senators of the College of Justice, granting to David Ballenie, indweller in Gilmortoune, and Margaret Young, his spouse, and the longest liver of them in conjunct fee and liferent, and the heirs male lawfully gotten or to be gotten betwixt them, who failing, to Margaret Ballenie, their only lawful daughter, whom failing, to the heirs and assignees of the said David whomsoever, (1) that tenement of land, houses and yard with the well belonging thereto at the eastend of the town of Gilmortoune (formerly possessed by the deceased James Richman, smith, and now by the said David Ballenie) between the common green on the south, "the gutter that comes from the cloass possest by William Mathie as it comes foranent the gavell of that house belonging to the said William Mathie his tenant (sic)" and presently possessed by himself, on the west, the high street that leads from Edinburgh to Newbotle on the east, and the highway that leads from the said high street to the houses presently possessed by Ronald Richardsone and his tenants and the dwelling house possessed by Alexander Richardsone on the north; (2) that piece of ground upon the east side of the said High Street between the gavel of the smiddy presently possessed by Alexander Richardsone, smith, and the door "cheek" of the house presently belonging to John Clark on the south and north, the yard belonging to them on the east and the said High Street on the west; and (3) that piece of ground comprehending 40 feet taken off the common green of Gilmortoune and added to the said David Ballenie's yard, and the barn built thereupon, all lying in the parish of Libertoune and sheriffdom of Edinburgh. Sasine given upon the ground of the said tenement of land and others, on 12 May 1676, by Thomas Warrock in Stainehous, bailie in Gilmortoun, to the said David Ballenie for himself and as procurator for his spouse and daughter |

Witnesses to the charter, John Dalzell, servitor of the granter, and John Jaffrey, writer in Edinburgh. Witnesses to the sasine, the said John Dalzell, John Gibsone, tenant in Gillmortoune, Stephan Dog, shoemaker there, Henrie Lowrie, wright there, and Alexander Jaffray, servitor to the foresaid John Jaffrey. The instrument is written by John Lovell, writer in Edinburgh.
