Title |
Contract of Marriage between Williame Stirling of Harbertshyre, on the one part, and Dame Helen St. Clare, Lady Bannockburne, with consent of James St. Clare of Rosline, her brother german, on the other part, whereby the said William Stirling, in contemplation of their marriage, and considering that there would accresce to him jure mariti during their joint lives the liferent and conjunct fee provided by the late Sir Johne Rollo of Bannockburne to the said Dame Helen St. Clare, his spouse, bound and obliged himself (1) to infeft the said Helen St. Clare, in liferent, in (a) the maynes of Herbertshyre (presently possessed by himself) with the park, castle or mansion house thereof, etc., and (b) a yearly annualrent of 2000 merks Scots furth of the lands and barony of Harbertshyre, lying in the parishes of Donypace and Dennie and sheriffdom of Stirling, the first instalment being paid at the first term of Whitsunday or Martinmas after his decease; and (2) to take the securities of the said lands and barony of Harbertshyre, the lands of Powhous in the parish of Logie and any other lands conquest and acquired by him during his lifetime, to himself and the heirs whatsoever of the said marriage, whom failing, to his own nearest lawful heirs and assignees whatsoever: With procuratory of resignation and precept of sasine. Witnesses, Archibald Sterling of Cardene, Lieut. Col. Mungow Halden, Mr. James Forsythe, minister of Sterling, John Wordie, commissary clerk of Sterling, Johne Richardsone in Fitt of Grine, Sir John Sterling of Keir, Patrick Grahame, son of the laird of Baquhapell, and George Sterling of Balwall. Mr. James Henrysone, writer, Edinburgh, wrote the Contract.
