Title |
Charter (much injured by damp) by John Chalmers of Gaitgirth, narrating that in a court of apprising held in the Tolbooth or New Session House of the burgh of Edinburgh, on 10th August 1667, in presence of John Daill, messenger, sheriff in that part, in virtue of Letters of Poinding and Apprising granted by the Lords of Council and Session the merkland of Dalharkow (commonly called the mylnetoun merkland) and the grain mill of Dalharkow, with the mill-lands of the same, all lying in the parish of Dalmellingtoun, Kyl Regis and sheriffdom of Air, together with the astricted multures after described, were apprised at the instance of Thomas Slos, his heirs and assignees, from Mariot Slos and Jonet Slos, lawful daughters and apparent heirs portioners lawfully commanded to enter heirs in special within 40 days to John Slos in Netherlaicht, their father, who died last vest and seised as of fee in the said subjects, in payment and satisfaction of the sum of £1324:13: 4d Scots of principal and £66: 4/- Scots of sheriffs fee, all as more fully contained in the decree and process of apprising led thereupon, duly seen and considered by the Lords of Session, who, by their deliverance of 30th August 1667, ordained the granter to infeft the said Thomas Slos in said subjects: He, therefore, in obedience to said command, granted to the said Thomas Sloss the said merkland and grain mill of Dalkarhow, with the mill lands and astricted multures of the said mill viz:- the astricted multure, which is the one-seventeenth peck of all the fruits and grain which shall happen to grow upon the four merkland of Dalharkow and the four merkland of Craig, with mill pond, the lade by which the water is brought to the mill, the mill close, the cleaning of the water channel by the tenants of said lands, as the custom is, and the "outintoun" multures, which is ½ peck from each boll of all fruits growing upon the four merkland of Constable, the two merkland of Leffanhill, the two merkland of Drumgrange, the four merkland of Keirhill and the two merkland of Dunsken and Burnhead, all of old extent, lying in the barony of Mairtinhame, Kyle Regis and sheriffdom of Air: To be held de me for payment of 10 merks Scots of feu-farm [? at Martinmas] yearly, the tenants appearing at the granters courts of Mairtinhame when required, and the feu-farm being doubled on the entry of heirs: With precept of sasine.
