Title |
Charter of Apprising under the Great Seal of King Charles II, whereby the king with consent of John, Earl of Rothes, Chancellor, John, Earl of Lauderdaill, Secretary of State for Scotland, John, Earl of Tueddale, William Lord Bellenden, Treasurer Depute, William, Lord Cochrane, Sir Robert Murray, formerly Clerk of Justiciary, commissioners for his Treasury Comptrollery and New Augmentation, and of the remanent Lords of the Exchequer, gave and granted to Hugh Sinclair of Inglistoun, his heirs and assignees, the lands of Easter Strathoir, with the manor-place, houses and yards etc., lying in the sheriffdom of Fyiff; one-sixth part of the lands of Wester Strathoir, one sixth part of the lands of Mitchelstoune, one-sixth part of the port called Westhaven with the mill of Hetpetmilne, mill-lands, multures, coals, coal-heughs etc. lying at the westend of the burgh of Dysert within said sheriffdom; the lands of Pitkenie and Cockenie with manor-place, houses, etc. lying within the barony of Kinghorne and sheriffdom foresaid; the lands of Eister Binnie with castle, tower, fortalice, etc. lying within the sheriffdom of Linlithgow, with the teind sheaves and other teinds as well parsonage as vicarage of the lands of Eister Binnie and one-fourth part of the lands of Pardovan lying within the parish of Linlithgow and sheriffdom foresaid; the kirklands of Inglishmaben with houses, yards, etc. lying within the town and territory of Inglishmaben and sheriffdom foresaid, reserving to the rector and vicar of Inglishmaben the vicarage manse with byre, yard, barn and orchard, and 4 acres of arable land of the said kirklands, one-half thereof being "feildland" and the other half "croftland", to be occupied, used and disponed by him and his successors in time coming; the lands of Blackburne called Litle Blackburne, with houses etc. lying within the barony of Whitburne and sheriffdom of Linlithgow; the lands of Meikle Blackburne with mill, mill lands, multures etc., the lands of Poddockshaw with houses, coals, coal-heughs etc., the lands of Torbaines alias Trees, with houses, yards etc., lying within the bounds and barony of Bathgait, by annexation within the sheriffdom of Linlithgow; together with the teinds both parsonage and vicarage of the whole of said lands so far as they have not hitherto been disponed: which lands were apprised from William Hammiltoun of Binnie for himself and as lawfully commanded to enter heir in special to the late Alexander Hammiltoun of Binnie, his brother, and the late Sir George Hammiltoun of Blackburne, his uncle, within 40 days, as follows: (1) at the instance of Hugh Somervaill, merchant, burgess of Edinburgh, and Marie Binnie, his spouse, in a court of apprising held on 20 September 1654 in presence of John Thomsone, messenger, in payment of £7966:13: 4 Scots of principal, and £398: 6: 8 of sheriff's fee, all as more fully contained in the decreet and process of apprising duly approved on 6th November 1654; in terms of which and of a charter R.M.S. x. No.359. under the great seal (dated 29 December 1654) the said Hugh Somervaill and spouse were duly infeft and seised in said lands by instrument of sasine No. GD86/611, who thereafter by disposition (dated 6 July and 1 October 1655) disponed the same to Mr. Robert Bruice, minister of Abirdour, and resigned them into the hands of the Commissioners of Exchequer in his favour: (2) at the instance of Thomas Wilsone, skipper, burgess of Kirkcaldie, in another court of apprising held in Edinburgh on 10 September 1658 in presence of Patrick Nisbett, messenger, in payment of the sum of 8805 merks 10 shillings and 8 pence Scots of principal and 440 merks Scots of sheriff's fee all as more fully contained in the decree and process of apprising approved on 11 September 1658; in terms of which and of a charter R.M.S. x. 675. under the great seal, he was infeft therein on 26 and 27 January 1659 by instrument of sasine under the hand of John Alexander, notary public, and thereafter by disposition (dated 6 August 1660) sold the same to the said Mr. Robert Bruice and resigned them into the hands of the Lords of Exchequer in his favour, who assigned the two dispositions in his favour to the said Hugh Sinclair by assignation dated 18 October 1665: (3) at the instance of Robert Stewart, provost of Linlithgow, in another court of apprising held in Edinburgh on 1st July 1654 in presence of Alexander Murray, messenger, in payment of the sum of £75, 457: 17: 8 Scots of principal and £3772:17: 8 of sheriff's fee, all as more fully contained in the decreet and process of apprising: in terms whereof and of a charter under the great seal, the said Robert Stewart was on 14 August 1654 infeft and seised in said subjects by instrument of sasine under the hand of Alexander Bell, notary public, which he thereafter resigned into the hands of the lords of the Treasury and Exchequer in favour of the said Hugh Sinclair conform to instrument under the hand of James Johnstoun, notary public, dated - September 1667: (4) at the instance of Major Robert Logan in payment of the sum of £7801:17: 4 Scots of principal and £390 of sheriff's fee all as more fully contained in the decreet and process of apprising; in terms whereof and of a charter R.M.S. ix.389. under the great seal the said Major Robert Logan was seised therein and thereafter disponed the same to George, Earl of Linlithgow, who assigned the same by assignation (dated - 1660) to John Drummond of Pitkellone, who with consent of Sir John Drummond of Burnbank, knight, for his interest, translated the same to the said Hugh Sinclair, in whose favour the said Major Robert Logane resigned the same into the hands of the lords of Exchequer: and (5) at the instance of David Dalrimple of Newtoun of Markinch for payment of the sum of 12,417 merks Scots of principal and 620 merks of sheriff's fee conform to process of apprising led on December 1662 and approved by the lords of Council and Session on 15th January thereafter; which sums the said David Dalrimple assigned as follows (1) by assignation (dated 1 October 1665) the sum of 3600 merks Scots thereof to William Lyndsay of Pyotstoun, who by his translation (dated 5 July 1667) transferred the same to the said Hugh Sinclair and (2) by assignation the remainder thereof to his sons (names blank) and John Home, his son-in-law, who translated the same to the said Hugh Sinclair; declaring that a sasine taken at the manor-place of Eistir Binnie shall be sufficient for the whole subjects. Witnesses William, Earl Marischall, marshall of Scotland, Sir Archibald Primrose of Dummany, clerk of the Rolls, Register, Council, Session, Exchequer and Parliament, John Home of Rentoun, Justice Clerk, and Sir William Ker of Hadden, knight, director of Chancery.
This charter has been much injured by damp, the greater part being indecipherable. The blanks have been supplied from the Precept from Chancery which follows. The charter is not booked in the Register of the Great Seal but see Reg. Sec. Sig. (Latin), Vol.IV, p. 194. |
