Title |
Instrument of Resignation and Sasine (defective) under the hand of William Mitchell, of the sheriffdom of Air, notary public and town clerk of Air, narrating that Robert McAllexander, writer, procurator for Thomas Knycht of Auldtoun of Corsbie, spouse of Jean Purveyance, lawful daughter and one of the heirs portioners of umquhile Johne Purveyance, merchant, burgess of Air (constituted by letters of procuratory and resignation in a contract of marriage, dated at Air 17 March 1658, between the said Thomas Knycht, on the one part, and the said Jean Purveyance with consent of Elizabeth Mirrie, her mother, on the other part) resigned that tenement of land, "heich and laich, back and foir", with the yard and all privileges and pertinents used and wont, lying near the Meill Mercat of the burgh of Air (under reservation of the liferent of [Agnes] Cunynghame, mother of the said Thomas therein) into the hands of Johne Crawfurd, one of the bailies of said burgh, in favour of the said Thomas Knycht and spouse and the longest liver of them and the heirs lawfully gotten or to be gotten betwixt them, whom failing, the nearest and lawful heirs and assignees of the said Thomas whomsoever, to whom the bailie gave sasine accordingly: Further, narrating that immediately thereafter the said Robert McAllexander, as procurator for the said Jean Purveyance, in terms of above letters of procuratory and resignation, resigned in name of tocher (a) that tenement of land in the burgh of Air which pertained to Johne Purveyance, her father, and now occupied and possessed by Andro Ramsay, baxter, and (b) that acre of land lying in the Laiche Sandis between the acre of land of umquhile Rysyd, now of [ ] on the south and the lands of Johne Garvane on the [north], into the hands of the said Johne Crawfurd in favour of the said Thomas Knight and the heirs lawfully procreated between him and the said Jean, whom failing, to the nearest and lawful heirs and assignees of the said Thomas whomsoever to whom the bailie gave sasine accordingly: Which subjects were provided to the said Jean Purveyance by her father as one-fifth part of his heritage, the said tenement of land being held of his Majestie in free burgage for service of burgh used and wont and the said acre of land of the provost, bailies, council and community of the burgh of Air in feu-farm for payment of the feuduties specified in the former infeftments. Done upon the ground of said subjects on 29th June 1658 |
