Title |
Charter of Resignation by Johne, Earl of Loudoune, granting to (a) John Aslos, eldest lawful son and apparent heir of Thomas Aslos in Constabill, portioner of Dalharrow, and the heirs to be lawfully procreated between him and Jonet Smyth, his spouse, whom failing, to the nearest heirs and assignees of the said John whomsoever, (1) the one-half of that merkland in Dalharrow called Mylne-toune-merkland, with houses, biggings and pertinents thereof (sometime occupied by Robert Murray and Williame Miller and now by the said Thomas Aslos), together with (a) one-half of the cornmyln of Dalharrow, the astricted multures which is the seventeenth peck of all corns that shall happen to grow upon the 4 merkland of Dalharrow and the 4 merkland of Craige and the miln lead or stank, watergang and clous of the said mill for bringing the water home, and cleansing the mill trows or spouts by the tenants of said lands as use is, and (b) the "outtentounes" multure, which is half a peck from the boll of all corns growing upon the 4 merkland of Constabill, the 2 merkland of Leffanehill, the 2 merkland of Drumgrange, the 4 merkland of Keirhill, and the 2 merkland of Dannasckane and Burneheid, all of old extent, lying in the barony of Martname and sheriffdom of Ayr; and (b) to the said John Aslos and spouse and the longest liver of them and the heirs lawfully procreated or to be procreated between them, whom failing, to the nearest and lawful heirs and assignees of the said John whomsoever, (2) the other half of the said merkland of Dalharrow with the houses, corn mill and astricted multures foresaid; which subjects were granted under reservation of the liferent of the said Thomas Aslos and of the liferent of Jonet Dun, his spouse, in one-third thereof, and were resigned into the hands of the granter by the said Thomas for new infeftment thereof to be given to his son and spouse: To be held of the granter for payment of 10 merks Scots yearly in name of feu-farm, with a double of the same in the first year of the entry of heirs and assignees thereto, and appearing at the granter's Courts of the barony of Martname whenever they shall be lawfully cited thereto: With precept of Sasine.
