Title |
Instrument of Sasine under the hand of James Smetoun, notary public, following upon and narrating the precept of sasine in a Charter under the Great Seal of The Protector (dated at Edinburgh 29th December 1654) granting to Hew Somervell, merchant, burgess of Edinburgh, and Mairie Bynnie, his spouse, and the longer liver of them in conjunct fee, and to the bairns lawfully gotten between them, whom failing, to the nearest and lawful heirs and assignees of the said Hew whomsoever, (1) the lands of Pitkeanie, Eister Strathore, Wester Strathore and Michaelstoune, with the houses, orchards, miln, miln-lands etc. and teind sheaves and other teinds, lying in the sheriffdom of Fyff, and (2) the towns and lands of Eister Bynnie, Eatrig, Pardyvane, Dogland, Farniehillis, Eaglischmauchane and kirklands thereof, Meikill Blackburne, Litle Blackburne and Paddokcschaw, with manor-places, towers, mosses, meadows, milns, miln-lands, teind sheaves and other teinds etc., together with the miln of [ ] lying at the west end of the town of Kirklistoune, miln-lands, etc. thereof, all lying in the sheriffdom of Linlithgow: which lands formerly pertained to Williame Hammiltoune of Pitkeanie, from whom they were lawfully apprised at the instance of the said Hew Somervell and spouse in satisfaction to them of the sums of 10,000 merks Scots of principal, £300 for the annual-rent thereof from Martinmas 1653 to Lammas 1654, £1000 of liquidate expenses, and £398: 6: 8 of sheriff's fee, conform to process and decreet of apprising led upon 20th September 1654 and ratified by the Commissioners for Administration of Justice on November following. Sasine given upon the ground of said lands of Pitkeanie (in virtue of dispensation in charter) on 6th March 1655 by David Thomsone in Pitkeanie, sheriff in that part, to William Crawfurd in Pitkeanie, attorney for the said Hew Somervell and spouse |
