Title |
Charter of Sale (defective) by Mr. James Nasmyth, minister of the word of God at the Church of Hammiltoun, whereby, in implement of letters of disposition (dated at Dalmellingtoun 2nd April 1649) granted by him to David Crawfurde of Kers and Margaret Chalmer, his spouse, he disponed to them and the longer liver of them in conjunct infeftment, and to the heirs lawfully procreated or to be procreated between them, whom failing, to the nearest heirs and assignees of the said David whomsoever, the following subjects lying in the parish of Dalmellingtoun and sheriffdom of Air, vizt: (1) the small house or merchant booth in the clachan of Dalmellingtoun built upon the north kirkyard dyke and presently occupied by the said David Crawfurde, and (2) that small piece or portion of land extending to 10 falls (computing [6] ells in length and breadth to each fall) lying on the south side of the said clachan beginning on the [? other] side of the yard of the late Gilbert Mure, and from thence towards the public highway on the east, with the houses occupied by the John McQuhonnell, all as described in the charter of feu-farm granted by Alan, Lord Cathcart, to William Stevenstoun of Barbeth; with liberty and privilege of brewing, and of selling merchandise within said town etc. used and wont: To be held de me, for payment of 20/- Scots in name of feu-farm, with a double of the same in the first year of entry of heirs: With precept of sasine.
