Title |
Instrument of Resignation and Sasine under the hand of Quintin Kennedy, clerk, of the diocese of Glasgow, and common clerk of the burgh of Air, notary public, narrating that Mr. David Kennedy, son of the notary, procurator for John Knight, dean of gild, burgess of Air (duly constituted by letters of obligation, of the date of these presents, containing procuratory of resignation) resigned (1) the ten shilling land of old extent of Twa-stane-croce with meadow and pertinents (formerly occupied by William Ker, John McMairtein younger and James Mure, burgesses of Air) at one time pertaining to James Johnestoun, burgess of said burgh, eldest lawful son and heir of James Johnestoun, burgess, formerly bailie of said burgh, and now to the said John Knight, lying within the Burrowfeild of Ayr and sheriffdom of the same; and (2) 2 acres of land with pertinents (alienated to the said John Knight by Archibald Johnestoun, second lawful son of the foresaid late James Johnestoun and Jonet Wallace, spouse of the said Archibald) occupied by James Mure and Patrick Dryiff, pedlar, and formerly by Patrick Glover, burgesses of Air, lying contiguous in that part of the lands of the Sands of said burgh called the "common mure" next adjacent to the chapel of St. Leonards, between the lands formerly pertaining to the late [ ] burgess of Air, and now to Ninian Cununghame, burgess of said burgh, on the south, and the lands of the late John Jamesoun and the common king's highway on the north, into the hands of Donald Smith, one of the bailies of the burgh of Air, (who had right to receive resignations in terms of an act of the town council dated 14 February 1640) in favour of the said John Knight and Agnes Cuninghame, his spouse, and the longer liver of them in conjunct infeftment, and Thomas Knight, lawful second son of the said John, his heirs and assignees, in fee; and that the bailie thereupon gave sasine to Adam Ritchie, formerly bailie of Air, attorney for the said John Knight and spouse, and to the said Thomas Knight personally present and accepting: To be held the said lands of Twa-stane-croce of the provost, bailies councillors and community of the burgh of Air in feu-farm for payment of 5 shillings Scots annually and the said 2 acres of the king in free burgage for payment of the services used and wont. Done upon the ground of said lands upon 19th February 1640 |
