Title |
Contract (imperfect) between Johne Strivling of Harbertschyre, on the one part, and David Forrester of Little Dunoven, on the other part, narrating that by contract drawn up but not perfected between Sir Robert Spottiswoode of Donypace, knight, president of the College of Justice, (in whose person the heritable right to the teinds aftermentioned is established) with consent of Adame Levingstoune, brother-german of Mr. Alexander Levingstoune, advocate, of the first part, the said Johne Strivling, of the second part, and Mr. Alexander Norie, minister of Donypace, of the third part, Sir Robert binds and obliges himself to infeft the said Johne Strivling in the teind sheaves and parsonage teind of the lands of Litle Dunoven lying in the barony of Harbertschyre, parish of Donypace and sheriffdom of Strivling; that on being infeft therein on completion of said contract, Strivling binds himself to sease Forrester (who was proprietor of the lands of Litle Dunoven) in the said teinds, and to relieve him from all actions against him or his tenants at the instance of the said Sir Robert Spottiswoode and Adame Levingstoune, Robert Levingstoune, merchant, burgess of Edinburgh, Heleine Malloch, his spouse, Sir Johne Carnaigie of Ethey, knight, or any other person regarding said teinds for crop and year 1634 and all subsequent crops; and that in consideration of the above infeftment, Forrester was to pay to Strivling the sum of £458:10: 8 by 11th November 1635.
