Precept of Warning by Adam Cwnynghame, advocate, heritable proprietor or rentaller of the lands after mentioned, commanding his officers (names blank) forty days preceding Whitsunday 1619 to warn James Lawsone in Rowken, John Glassell, John Glassell, wobster, Michell Cowter, Patrick Neilsone, Patrick Mair, Jonat Burnet, Johnne Mair, Robert Glassell, Johne Lawsone, John Glassell, smith, John Glassell, maltman, Katharein Kirkpatrik, Thomas Glassell, John Wichtman, Agnes Johnstoun, Thomas Cowter, "callit Ridcloik", Mathow Cowter, John Burnet, Thomas Burnet, Edward Haliday, Edward Cowter, Margaret Cairlell, Jonat Potter, widow, James Suan, Andro Potter, Frances Potter, James Clark, Edward Johnstoun all in Tounfut of Rowken and Johnne Ritchartsone in Torthorwald, pretended tenants and occupiers of those parts and portions of his meadow of Rowken with pertinents lying on the south and south-west sides of the Water of Lochar adjacent to his lands of Dargavell, between the said Water of Lochar and the lands of Over Middill and Nether Dargavell, within the parish and sheriffdom of Drumfreis, to flit and remove therefrom at Whitsunday 1619. Witnesses, William Cunynghame and Johnne McMyne, his servitors.
Signed by the granter and witnesses.
In dorso: Certificate of Execution (dated 2nd April 1619) by Thomas Scot certifying that he lawfully warned Johne Glassell, wobster in Roken, Johne Glassell, Michell Cowter, Patrik Neilsone, Patrik Mair, Jonat Burnet, John Glassell, smith, Katharein Kirkpatrik, Thomas Glassell, Johnne Wichtman, Agnes Johnstoun, Johnne Burnet, Thomas Burnet, Margaret Cairlell, Jonat Potter, widow, Andro Potter and James Clark, all in Tounfit of Roken, personally apprehended, and James Lawsone, Johnne Mair, Robert Glassell, Johnne Lawsone, Johnne Glessell, maltman, Thomas Cowter "callit Ridcloik", Mathew Cowter, Edward Haliday, Edward Cowter, James Swan, Frances Potter and Edward Johnstoun in Rowken and John Ritchartsone in Torthorwald, all at their dwelling places; and that he immediately thereafter passed to the ground of said lands and warned the above persons and affixed and left copies of the precept upon the ground upon cloven sticks. Witnesses, Williame Cwnynghame, son of the late Harbert Cwnynghame, provost of Drumfreis, and James Scot, son of David Scot in Dargavell. Certificate of Execution (dated 4th April 1619) by Johnne Maxwell, messenger, certifying that he passed to the parish kirk of Torthorwald and there read the said precept before the parishioners and affixed a copy to the most patent door of the kirk. Witnesses Harbert Cwnynghame, town clerk of Drumfreis, William Cwnynghame, his brother, George Maxwell and John Baitie, servitors of the said Harbert Cwnynghame. |
