Title |
Charter of Confirmation by Hugh Broun, burgess of Edinburgh, the king's principal bailie of his seaport of Our Lady the Queen (domine nostre Regine) commonly called Newheavin, confirming a Charter of Sale (dated at Edinburgh 2nd February 1616) by Mr. Robert Wardlaw, feuar of the lands aftermentioned, with consent of Margaret Foster (Forrestar), his spouse, and Mr. William Scott of Elie, one of the clerks of the king's Session and Council, at whose instance he was interdicted, whereby in implement of letters of obligation (of even date with the charter) granted by him with consent of his spouse to Edmund Smyth, tailor, burgess of the Canongait, he sold to the said Edmund Smyth, his heirs and assignees whomsoever, (1) 2½ acres of land with pertinents lying within the bounds of Newheavin and sheriffdom of Edinburgh, between the lands formerly pertaining to Robert Bartane of Ovir Berntoun on the south and west, the common highway on the north, and an acre of land pertaining to the Altar of the Holy Blood on the east; (2) an acre of land with pertinents lying within the foresaid bounds, between the lands of the late William Bell on the east, the lands of James Thomsoun on the west, the Hillheid and drop-fall of the same on the north, and the common passage or highway on the south; (3) 6 particates of land with pertinents lying within the foresaid bounds, between the lands of James Thomsoun on the east, the common passage on the south, the lands of the late John Andersoun on the west, and the Hil-heid and drop-fall of the same on the north; (4) 7 particates of land with pertinents lying contiguous between the lands of the late Patrick Brountscheillis on the east, the lands of the late Robert Andersoun, baker, on the west, the common highway on the south, and the passage to the ebb and flow of the sea on the north; and (5) 3 acres of land with pertinents which formerly pertained to George Thomsoun lying within the bounds of the port and lands of Newheavin, between the lands of the late Thomas Hoppringill on the west, the lands of the late John Crawfurd of Bonytoun on the east and south, and the king's highway on the north; of which acres and particates of lands, four acres are occupied by Archibald Gibsoun, skipper, indweller in Leyth, and other 5 acres by John Wardlaw in Leith: To be held a me, rendering therefor the feu-farm and other duties specified in the original charters and infeftments: With precept of sasine addressed to James Zoung, tailor, burgess of the Canongate. |

At Edinburgh 28th June 1616 Witnesses to the Charter of Sale, Archibald Hammiltoun and John Moir, servitors of the said Mr. William Scott, Alexander Smyth, lawful son of the said Edmund Smyth and Alexander Nicoll and John Johnnestoun, servitors of the said Edmund. Witnesses to the Charter of Confirmation, George Penstoun, tailor, burgess of the Canongate, the said Alexander Smyth, John Johnnestoun, tailor, indweller in the Canongate, and David Robesoun, notary public. The Charter of Sale is written by Mr. John Paipe, younger, writer, Edinburgh, and the Charter of Confirmation by George Norvell, notary. Signed by the granter and witnesses. Seals gone. |
