Precept of Warning by Adam Cwnynghame, advocate, commanding his officers (names blank) 40 days preceding Whitsunday 1616 to warn Herbert Maxwell of Kilbene "callit of Tynwald", Johnne Maxwell, his son, Homer Maxwell of Speddoche, Edward Maxwell of Tynwald, Nicolas Chartouris, his mother, relict of William Maxwell of Tynwald, Johnne Gaw in Bruntiskarth, Herbert Mairtene, there, Herbert Gaw, there, Herbert Mairtene, there, William Blunt, there, Phillope Coipland, there, Thomas Newall of the Hill, William Hanyng, there, David Hanying, there, Johnne McKynnell in Bruntiskarth, Thomas McKynnell, there, Johnne Gilmure, there, Patrik Swan, there, Thomas Newell in Tounfute, Johnne Kirkpatrik of Freircars, Johnne Wallace in Carrizeild, Johnne Slewman in Auchincreith, Johnne McKynnell and Robert McKynnell, there, pretended tenants and occupiers of that part of his 40 shilling land of Dargavell, otherwise called Lochirmos, lying on the southeast and east sides of Meggis Myre, and meadows muirs and mosses thereof which are proper parts and pertinents of the said lands of Dargavell, within the parish and sheriffdom of Drumfreis, to flit and remove therefrom at Whitsunday 1616. Witnesses, Johnne Makmyne and Adame Clerk, servants of the granter. Signed by the granter.
In dorso:- Certificate of Execution (dated 5th April 1616) by Johnne McMyne certifying that he lawfully warned the said Nicolas Chartouris, Edward Maxwell, her son, Thomas Newall in the Know of Bruntskarthe, Phillop Coipland, William Coipland, his son, John Carrutheris, James McKinnell, John Gaw, and Harbert Gaw, all in Bruntskarthe, all personally apprehended, and James McKinnell in Bruntskarthe, Thomas Newall in Tounfit of Bruntskarthe and John Gilmour, there, all at their dwelling places; and that he immediately thereafter passed to the ground of said lands and warned the above persons and affixed and left copies of the warning upon the ground upon cloven sticks. Witnesses, James Hammiltoun, servitor to David Scot in Dargavell, and John Murdoche, servitor to William Haliday in Dargavell. Certificate of Execution (dated 7th April 1616) by John Richartsone certifying that he passed to the parish kirk of Drumfreis and there read the said precept before the parishioners and affixed a copy to the most patent door of the kirk. Witnesses, James Maxwell, cordiner, burgess of Drumfreis and Thomas Diksone, cordiner there. |
