Title |
Feu Charter by William, Earl of Tullybardine, Lord Murray, Gask and Balquhidder, whereby, in implement of a contract (dated at Edinburgh 4 March 1616) entered into between him, on the one part, and John Reid, eldest lawful son of Adam Reid in Pitnacrie, (native and kindly tenant of the lands aftermentioned) he granted in feu-farm to the said John Reid and his heirs and assignees whomsoever, the £4 lands of Pitnacries Eister and Wester (occupied by him and his tenants), and the mill of Pitnacrie, with mill lands, astricted multures, sequels and services used and wont from the lands of Pitnacries Eister and Wester, Bellequhanis Eister and Waster, Ballezewmontis Eister and Wester, Eister and Wester Tyris, otherwise called Ballarchibald, the Manis and Inche of Logyreit and the lands of Eister Dumfallandy; with salmon fishings upon the Water of Tay, the ferry boat thereon in so far as it effeirs to the lands of Pitnacries and they extend east and west along said Water, and "scheillingis, grissingis" etc. pertaining to said lands of Pitnacries: To be held de nobis, rendering therefor yearly £8: 6: 8 for "mairtstig and herezeldis" used and wont to be paid as the ancient ferms of said lands, £7:13: 4 Scots in augmentation of rental, extending altogether to £16 Scots, and £5:12: 8 being the proportion applicable to the lands of Pitnacrie of the feuduty due to the king for the barony or tenandry of Logyreit: Further, the heirs of the grantee are to pay a double of the feuduty in the first year of their entry to said lands, and should two terms run into a third unpaid, the vassal is to pay a double of the said three terms, with power to the superior to poind and distrain therefor; and providing that should the vassal obstruct the superior's officers in the execution of the poinding, he should lose his liferent of said lands: Moreover the vassal is bound (1) to relieve the superior of all taxations to be imposed on said lands by royal authority; (2) to be present at the three chief courts of the earldom of Atholl to be held at Logyreit without any premonition, and at all other courts to be held within the barony or tenandry of Logyrat or earldom of Atholl on 15 days premonition: (3) to serve, at his own expense, his superior, in the earldom at war and in his huntings, watchings and imprisonings when required for the safety of the country, and also at his own expense to serve and give obedience to him in his affairs within the bounds of Atholl, Dunkeld, Perth, Gask and Tullybardin, but otherwise at the superior's expense; and (4) not to shew himself with any one as an adversary of the superior, the king alone excepted nor to raise or conceal any action tending to his prejudice under pain of forfeiture. The granter is prohibited from alienating the lands to any person beyond the east side of the Water of Rattray from head to foot, the west side of the Water of Lyone, and above the head of Rannoch, without the consent of the superiors: With precept of sasine addressed to Sir James Stewart of Ballequhan, knight.
