Title |
Procuratory of Resignation by Mr. Alexander Levingstoun [advocate] in Edinburgh, at whose instance the lands aftermentioned were apprised, with consent of James Ballantyne (Balleendene) of Kilmukis, formerly of Spittellis, heritable proprietor of said lands, whereby in implement of his part of a contract (dated 14th and 21st March 1616) entered into between him, with consent foresaid, on the one part, and David Weymis of Fyngask, on the other part, he constituted Robert Auchmoutie, servitor to Sir Johne Weimys of that Ilk, knight, his procurator for resigning the lands of Eister Kilmukis and Colleistoun, with the manor place of Eister Kilmukis, tower, fortalice, orchards, yards and pertinents, lying within the barony of Kilconquhair, regality of St. Androis and sheriffdom of Fyff, into the hands of the said Sir John Weimys and John Weymes fiar of that Ilk upon 29th March 1616, in favour of the said David Weymis, whom failing, Harie Weymis of Fudie, his brother-german, and the heirs male to be lawfully gotten of his body, whom failing, the said David's heirs and assignees whomsoever. Witnesses, Mr. Alexander Gibsoun of Durie, one of the ordinary clerks of session, James Kynnear, writer to the signet, John Belscheis, advocate in Edinburgh, William Liddell, writer in Edinburgh, Gavin Wemis of Unthank, Mr. William Wemis, advocate, and Mr. Patrick Wemys, one of the masters of St. Leonards College. Written by Patrik Nicolsoun, servitor of the granter. Signed by the granter, consenter and witnesses. The Seals (in good preservation) of the granter and consenter are attached:- Granter, see GD86/420. Consenter, A stag head erased between three cross crosslets fitchée, two in chief and one in base.
