Title |
Instrument under the hand of James Gray, clerk, of the diocese of St. Andrews, notary public, following upon and narrating a precept of kenning (dated 28 March 1610) by Alexander Dowglas, Mr. Williame Stewart, James Chalmer and David Brysoun, ordinary macers of Council and Session, sheriffs of the sheriffdom of Edinburgh principal and within the constabulary of Hadingtoun, and of the sheriffdoms of Dumfreis, Perth, Peibles and Selkirk in that part, commanding Williame Geddes, their bailie, to cognosce, ken and enter Dame Margaret Ker, widow of James, Lord Hay of Zester, to her terce of the following lands which were erected into the lordship and barony Zester viz: the lands, lordship and barony of Zester, with the castle etc. and the advocation of the college kirk of Bothanis, provostry and prebendaries thereof, the lands and mains of Park, the lands of Gammilstoun, the lands of Giffertgait and superiority thereof, the lands of Lynplum (one-fourth part in property and the rest in superiority), the lands of Duncanelaw, except the lands mortified to the kirk, the lands of Barro and superiority thereof, and one-fourth part of the town and lands of Blance, lying within the sheriffdom of Edinburgh and constabulary of Hadingtoun; the lands and barony of Lochquharrat, with mills, woods etc. in the sheriffdom of Edinburgh principal; the lands of Easter Hoprew, Edstoun and Megot, the lands and barony of Olivercastell with castles etc. and the superiority of the lands of Todreik, in the sheriffdom of Selkirk, united and annexed to the said barony of Olivercastell; the lands and barony of Lyne and Wester Hoprew, the lands of Jedburghfeild with the office of sheriff of Peiblis, the castle of Neidpeth and one-half of the barony of Glenrusco, in the sheriffdom of Peiblis; the lands and barony of Sned with fishings &c. in the sheriffdom of Dumfreis; and one-quarter of the lands and barony of Polgevie in the sheriffdom of Perth; excepting the town and lands of Beltoun with the miln thereof, and the lands of Gilpallat and Bentitod which are parts thereof, the lands and mains of Zesterpark and mill thereof and the lands and mains of Heidinghill, already pertaining to her in liferent: in which lands it was found by inquest that the said James Lord Hay who died in February 1609, was vest and seised and from which she was entitled to have a reasonable terce, to which she was served, the said terce falling to her "be lot of cors and pyle castin in our presence". The said bailie thereupon passed successively to the lands of Blance, Gammilstoun, Zester and Duncanelaw, and there in terms of the precept acknowledged, cognosced, kend and entered the said Dame Margaret to her terce of said lands by delivery of earth and stone of the lands of Blance into the hands of James Stevin in Blans, and of earth and stone of the other lands into the hands of Robert Fleyming in Clydesyde, her attornies.
