Title |
Extract (incomplete) from the Books of Council and Session of Contract of Wadset between Sir Johnne Meluill of Carnebie, knight, Dame Eleis alias Helene Ros, his spouse, and Robert Meluill, their eldest son and apparent heir, with consent of Margaret Meluill, only child procreated between Sir Johnne and the late Beatrix Barclay, his spouse, and James Hammiltoun of Kilbrachmont, for their interest, on the one part, and Patrik Huntar, portioner of Newtoun, and Dorothie Forbes, his spouse, on the other part, whereby Sir Johnne, in consideration of the sum of 7000 merks paid to him by Huntar and his spouse, bound and obliged himself to infeft them and the longest liver of them in conjunct fee in the lands of Over Carnebie with that part of the Cottoun Croft pertaining to Sir Johnne and the lands called the Templelandis, with right to cast fuel, feal or divot within the King's-mwir, lying in the sheriffdom of Fyiff, redeemable on payment of the principal sum: that part of the said lands called Lochtie and the backside of Over Carnebie (occupied by Andro Myln) are excepted therefrom, and it is declared that the lands are worth yearly 84 bolls, 2 firlots "cheritie" bear, 67 bolls, 2 firlots oatmeal, £30 silver duty and 12 dozen poultry. Further, (1) Sir Johnne binds himself to cause the tenants renounce their tacks in favour of Huntar who is to renew them on the same terms for five years, and he assigns to Huntar his right to the teind sheaves and small teinds of said lands and if he should obtain a tack thereof, Huntar is to pay as at present 15 bolls oats and 3 bolls bear only; (2) Margaret Meluill discharges an annualrent of 400 merks furth of the above lands; and (3) Hammiltoun of Kilbrachmont constitutes Huntar his assignee in and to the renunciation of the liferent of Johne Meluill, elder of Carnebie, and Sir Johnne transfers to him the liferent and escheat of Meluill which he acquired from James Meluill, son of Walter Meluill, donator thereto, in so far as concerns said lands.
