Title |
Indenture (in Scots) entered into at Aberdene on 17 July 1487 between William, Earl of Eroll, Lord Hay, constable of Scotland, Bettarage Dunbar, relict of Gilbert Hay of Vry and William Hay, son and apparent heir of the said Mr Gilbert and Bettarage, on the one part, and Archebald Rate of Drumtocty, on the other part, whereby the said Earl binds himself to infeft the said William Hay in the lordship of Vry, lying in the barony of Erole and sheriffdom of Kyncardin, which his said father possessed, and also to enter him in the fee of the lands of Crechmond in the sheriffdom of Aberdeen under reservation of his mother's liferent. The said William after his entry to the lordship of Vry is to marry Katerine Rate, daughter of the said Archebald, who binds himself to pay to the Earl the sum of 500 merks at the terms and in the proportions therein specified. It is also provided that the said William, for dispensing with him "in his age" and entering him in the lands of Vry, the ward of which is "unrwne", and also for the expense to be incurred in entering him in the fee of the lands of Crechmond, should pay to the Earl the sum of 400 merks for which he was to grant a bond under his seal that the lands of Monqueche, two parts of the lands of Glichtnoy and two parts of the Karntore should remain with the Earl until the said sum was paid. The writs of the lands of Vry were to be delivered to the said Archebald and those of Crechmond and Kilmalamage were to be in the hands of William Hay of Ardendracht "be the sicht" of the said Archebald and his heirs who were to have transumpts thereof, and also to have a letter of bailiary of the lands of Vry from the said William Hay for uplifting the rents thereof until the above sum of 400 merks due to the Earl was discharged. In the event of the said William divorcing the said Katherine, he was to pay to the said Archebald the sum of 1000 merks within three months of the divorce for great sums of money and goods received for the said marriage and for costs and damages thereby sustained |
