Title |
Instrument of Resignation and Sasine under the hand of John Masoun, town clerk of Air, notary public, narrating that George Fareis, burgess of Air, and Jonet Johnestoun, his spouse, received from William Rysyde, burgess of said burgh, for himself and on behalf of James Rysyde, his son, procreated between him and Elizabeth or Bessie Johnestoun, his spouse, the sum of 500 merks Scots for redemption of one-half of a piece of land of the lands of Twastanecroce called Stokrodding, extending to 3 acres of land or thereabout (occupied by the said George Fareis), lying in the territory of the Burrowfeld of said burgh and within the sheriffdom of the same; which lands under reversion of said sum of 500 merks, were alienated to the said George Fareis and spouse by Adam Johnestoun, burgess of Air, and Giles Fergushill, his spouse, conform to contract entered into between them dated 22nd May 1598 and to which right of reversion the said William Rysyde acquired right from the said Adam Johnestoun and spouse, James Johnestoun, their son, and Isobell George, his spouse, by disposition and assignation dated 10th November 1600; and that on 7th August 1602 the said George Fareis and spouse resigned said lands into the hands of George Cochren, one of the bailies of the burgh of Air, in favour of the said William Rysyde in liferent and James Rysyde, his son, in fee: Moreover the said Jonet Johnestoun without the presence of her husband gave her great and bodily oath in presence of the said bailie that she was not compelled or coacted to grant said resignation but did so of her own free will. Sasine given by the said bailie on 10th August 1602 to the said William Rysyde and son in liferent and fee respectively in terms of said resignation and of a Feu Charter granted to them by the provost, bailies, council and community of Air for payment yearly of 12 pence Scots and the rights and services used and wont. Done quoad the resignation and the taking of the oath in the house of the resigners within the burgh of Air and quoad the sasine upon the ground of said lands |

Witnesses to the resignation, David Fergushill, John Osburne and John Dunbar, co-burgesses of the burgh of Air. Witnesses to the sasine, Adam Wallace in Carcluy, John Busbie, burgess of Air, servitor of John Rankene, also burgess thereof, and Andrew Miller, sergeant of Air.
In dorso:- Memorandum under the hand of the notary narrating that the said Bessie Johnestoun compeared in his presence immediately before the giving of sasine and declared in answer to her husband that she was not desirous to have liferent sasine of above subjects and consented to James Rysyde her son being infeft therein. Done on the lands of Stokrodding on 10th August 1602. Witnesses same as to Sasine. |
