Title |
Obligation by James Mowat, Agent for the Kirk, for himself and Jonet Hay, his spouse, narrating that by contract (of the date of these presents) entered into between them, on the one part, and Johnne Hay of Urie, and Willeam Hay, his eldest son and apparent heir, with consent of Issobell Irwing, spouse of the said Johnne, on the other part, for the alienation to them of the third part of the Maynis of Urie called Pathbach (occupied by the said James) lying in the barony of Urie and sheriffdom of Kincardin, the said Johnne and Willeam are bound to deliver to them and the longer liver a letter of tack of said lands for 19 years after the redemption thereof at a yearly rent of 4 bolls bear and 16 bolls oatmeal, and granting that in case it shall happen that neither they nor the heirs of their body shall occupy the said lands with their own proper "plewche guidis and geir" but shall set the same to tenants, that the said tenants shall be astricted to pay arriage, carriage and customs to the said Johnne Hay according to use and wont.
