Title |
Contract between Mr. Villiame Lundy of that Ilk, Elizabethe Lundy, his spouse, and Robert Lundy, their son, with consent of his father as his administrator and tutor, of the first part, and David Vemeis, son of the late David Vemeis of that Ilk, of the second part, whereby the second party, in consideration of the sum of 2688 merks Scots, constitutes the said Villiame Lundy and spouse and the longer liver of them for all the days of their lives, and thereafter the said Robert Lundy and the lawful heirs male of his body, whom failing, David Lundy, his brother german, and the lawful heirs male of his body, whom failing, the said Robert Lundy's nearest and lawful heirs and assignees whomsoever, his cessioners and assignees in and to (1) a contract (dated at Vemeis 21 November 1595 and registered in the Books of Session 17 January 1597) entered into between Sir David Meldrum of Segy, knight, as principal, and David Narne of Sandfurd and Robert Bruce, younger of Pitlethie, his cautioners, on the one part, and David Wemeis of that Ilk and David Vemeis, his son, on the other part, whereby, in consideration of the sum of 2000 merks Scots Sir David bound himself to infeft the said David Vemeis of that Ilk in liferent and his son and the heirs to be lawfully procreated of his body in fee, whom failing, Harie Vemeis, his brother, and his heirs and assignees whomsoever, in an annual rent of 60 bolls "cheritie" bear furth of his lands of Segy, Segyhill and Bruchtie, lying in the barony of Segy and sheriffdom of Fyffe, redeemable on payment of the principal sum, and (2) the charter and other writs following thereupon. Further, the said Sir David Meldrum agrees that the said sum of 2688 merks Scots should be allowed as part payment of the sum of 40,000 merks Scots due by Lundy and his son to him for the sale of the lands of Newhall and Lethame with the mill and mill lands thereof, and of the lands of Segy and Segyhill in warrandice thereof, lying in the sheriffdom of Fyffe, conform to contract (dated [at Lundy 14 Vol. 53, folio 140.] April and registered in the Books of Council 28 May 1596) entered into between them.
