Title |
Instrument under the hand of John Masoun, town clerk of Air, notary public, narrating that by an inquest made by the provost and bailies of the burgh of Air, in the Tolbooth thereof on 30 April 1593, it was found that Margaret and Jonet were nearest and lawful heirs portioners of the late William Wallace of Quhithous, burgess of Air, their father, in (1) an acre of land with pertinents lying in the Sands of the said burgh in that portion leading from the barns and kilns of the late John Makquatty to the turfery (glebaria) of Spittelbog, between an acre of land of the late John Lokhert on the south and an acre of land of the late John McKnedar on the north, and (2) an acre of land with pertinents lying in the middle portion of the Sands of said burgh, between an acre of land formerly the property of Alexander Cwninghame, as also of said William Wallace, then pertaining to William Rysyd, on the south and an (? acre) of land of the late Robert Renkene on the north, and that they were therefore infeft therein by Adam Johnestoun, one of the bailies of the burgh of Air, to be held of the provost and bailies thereof: Thereafter the said Jonet Wallace, uncompelled and of her own free will, with consent of Robert Makmillen, her spouse, resigned her one-half of said 2 acres into the hands of the bailie in favour of her said sister Margaret, to whom the bailie gave sasine accordingly: Moreover the said Jonet compeared in presence of the bailie outwith the presence of her husband and gave her bodily oath that she was not compelled or coacted to make said resignation. Done upon the ground of said two acres on 24 or 25 November 1593 |
