Title |
Instrument of Sasine under the hand of Patrick Chalmer, clerk, of the diocese of Aberdeen, notary public, following upon and narrating a precept under the testimony of the great seal of Mary, Queen of Scots (dated at Edinburgh 8th May 1567) addressed to the sheriff of Banff and his bailies and to James Ogilvy, son of the late John Ogilvy of Glashauch also designed "of Forskan", her sheriff in that part, for infefting Walter Ogilvy, grandson and heir apparent of James Ogilvy of that Ilk and of Findlatter, and his heirs male, in (1) the lands and barony of Ogilvy viz: Findletter, Deskfurd, with mills, fishings, woods, etc., the lands of Blairschynocht, Castlefeild and Castlezardis, with the office of constable of Cullen, the constabulary lands called Pettinbringanis and the right of patronage of the churches and chaplainries of Cullan and Deskfurd, lying by annexation within the barony of Ogilvy and in the sheriffdom of Banff, and (2) the fishings of the Water of Ythane within the sheriffdom of Aberdeen: which subjects formerly pertained heritably to the said James Ogilvy of that Ilk who, in implement of a contract (registered in the Books of Council) entered into between James, Lord Ogilvy, and himself for his own interest and as tutor dative to his said grandson, resigned the same, under reservation of his own liferent, into the hands of the Queen at Edinburgh, who thereupon ratified the union of the said barony and of the other lands etc. and declared that sasine taken at the Castle of Findlatter should be sufficient for the same. Sasine of the whole subjects given by the said James Ogilvy, sheriff in that part, at the said Castle, on 26 May 1567, to the said Walter Ogilvy, present and accepting; and thereafter at the town and lands of Inzattre, as the principal messuage of the lands of Deskfurd, sasine of the said lands of Deskfurd, with mill etc., and at the lands of Castelfeild of the said lands and of the lands of Castelzardis, office of constable, constabulary lands and right of patronage |
