Instrument under the hand of Ninian Brys, presbyter of the diocese of Glasgow, notary public, narrating that Robert Hammiltoun of Cobelhauch compeared in his presence and handed to him to be read, copied and reduced to a public form of instrument a Schedule of Appeal (written on paper) by the said Robert Hammiltoun to Pope Paul III against the sentence pronounced by Mr. John Storwith, canon of Glasgow, commissary of Gavin, archbishop of Glasgow, and judge in the action raised by the appellant's mother, Isobell Hammiltoun, relict and one of the executors of James Hammiltoun, father of the appellant, for restoration and delivery of certain goods disponed by testament (bona testata) and specified in her articles of libel: He acknowledged by his oath that he had intromitted with the said goods and asserted that he had a right to do so because his father had constituted him one of his executors at the time of his decease and principal intromitter with his goods, but that the said commissary had nevertheless pronounced decree against him.
