Title |
Instrument of Resignation and Sasine under the hand of Henry Prestoun, clerk of the diocese of Glasgow, notary public, narrating that John Makcarrell, burgess of Aire, resigned the loft (solium) of the fore-tenement of the late William Broun lying in the burgh of Aire (between the tenement of Thomas Stevinsoun on the south and the tenement of William Williamesoun on the north) which Margaret Broun daughter and heir of the said William, had redeemed from the said John Makcarrell by payment of four pounds and twelve pence Scots, into the hands of Stephen Prestoun, one of the bailies of the said burgh, who thereupon gave sasine of the said loft, and of a shop or forebooth under the same, to the said Margaret as heir to her father: Thereafter the said Margaret, outwith the presence of John Pettegrew her husband, compeared in presence of the bailie as her judge ordinary sitting in a burgh court on the ground of said fore-tenement, and there gave her oath that she was in noways compelled or coacted to resign said tenement in favour of her husband but that she did so of her own free will on account of the marriage made and contracted between them, and that she would never do anything to the contrary in time coming: she thereupon resigned said fore-tenement into the hands of the bailie, who gave sasine thereof to herself and spouse and the longer liver of them in conjunct infeftment, and the heirs lawfully procreated or to be procreated between them, whom failing, to the lawful and nearer heirs of the said John; to be held more burgali. Done quoad the resignation in the lodging of the said John Makcarrell and quoad the remainder on the ground of said fore-tenement on 24 May 1542 |
