Description |
Containing: (1) Interlocutory Sentence pronounced by him, as sub-deputy of Mr. Robert Creichtoun, provost of the Collegiate Church of St. Giles of Edinburgh, deputy of the Apostolic See, the Chancellor of Aberdeen, the Precentor of Moray and others not named, in an Action of Appeal by John Striveling of Keir, knight, appellant, against John Lord Lyle, appellee, (1) confirming and approving the Interlocutory Sentence pronounced by Mr. Mathew Stewart, canon of the Metropolitan Church of Glasgow, commissary of Mr. Adam Colquhoun, canon of the said Church and official general of Glasgow, by which he decerned that letters executorial ought not to be levied at the instance of the appellant against Lord Lyle for non-implement of a contract (dated 23rd March 1522) entered into between them and registered in the Books of said Official; and (2) awarding expenses against the appellant; (2) Definitive Sentence in similar terms to the preceding relating to a contract (dated 23rd March 1522) entered into between Striveling and Lord Lyle; (3) Definitive Sentence pronounced by Williamson, as sub-deputy of Mr. William Gibsoun, dean of the Collegiate Church of Our Lady of Restalrig, and Mr. John Reid, chancellor of the Cathedral Church of Aberdeen, deputies of the Apostolic See, the provost of Our Lady of the Fields and others not named, in an Action of Appeal at the instance of William, Lord Sempill, appellant, against John Lord Lyle, appellee, (1) confirmimg and approving the Interlocutory Sentence pronounced by Mr. John Sprowle, canon of the Church of Glasgow and commissary of the said Mr. Adam Colquhoun, by which he decerned that letters executorials, raised at the instance of Lord Lyle against Lord Sempill, on account of non payment of £48: 6:8 Scots resting unpaid of a larger sum contained in an act registered in the Books of the said Official, be put to further execution etc., and (2) decerning against Lord Sempill for the expenses of the action; and (4) Definitive Sentence pronounced by Williamson, as sub-deputy of Gibsoun and Reid and the Precentor of Moray, in an Action of Appeal at the instance of Sempill, appellant, against Lyle, appellee, (1) confirming and approving the Interlocutory Sentence pronounced by the said John Sprowle by which he decerned that the letters compulsitor or executorial raised at the instance of Sempill for non payment of the sum of £59 should not be put to further execution; and (2) decerning against Sempill for the expenses of the action. These Sentences were read published and reduced to writing on 7th November 1537 at the Altar of St. James the Apostle, situated in the Collegiate Church of St. Giles of Edinburgh, in presence of Lord Lyle, and under pain of contumacy of Mr. James Carmour, procurator of the Laird of Keir and Lord Sempill, cited and not compearing. Witnesses, Mr. John Weddell, official of St. Andrews within the archdeaconry of Lothian, George, abbot of Dumferling, Thomas Kincragy, M.A., Alexander Spens, burgess of Edinburgh, Sir Thomas Gottorsoun and Sir James Arthour, chaplains. The Seal of the sub-deputy which was impressed on the paper at Edinburgh on 19th November 1537, has disappeared.
