Title |
Crown Summons of Error against the assize that on 19 Sept. 1593, found that Janet Agnew was heir to her deceast father, Quintin Agnew of Killumquha, - because that assize erred upon a principal article, namely that Andrew Agnew brother of the said Quintin died infeft in the lands; that Andrew survived Quintin and that Ninian Agnew son of Andrew was vested in the lands after Andrew's death; and because it is certain that Walter Agnew son of the said Ninian is the lawful heir to the said lands of Killumquha-Agnew and Nether Grenane and is not yet of 16 years of age; and because there has been collusion between Walter and Janet to the prejudice of John McDowell of Logane the superior; and that Janet was a sexagenarian and that Walter was heir in the said lands.
