Title |
Instrument at the hand of Alexander Agnew N.P., narrating that at a miln court at the milne of Clonyard held by Patrick McDowell of Logane by virtue of Crown Charter in his favour, Alexander McCulloch of Drumorrell as procurator for James McCulloch of Mule, John Gordon of Clonyeard and George McCulloch of Torhous protested against the holding of the Court as none of the said heretors of the Barony of Clonyeard were in use to appear at such a milne court and that what duties are due by them or the tenants of the Barony to the said miln were formerly judged by the said John Gordon who was Baron of that Barony. Patrick McDowell answered that though Clonyeard baron court formerly included a miln court both were consolidated; yet he had good right to affix a miln court seeing he was infeft in the miln, lands and multures on disposition and charter from the said John Gordon which empowered him to hold such courts and amerciat absents. Whereat Alexander protested that no action of miln multures should be against the tenants of the lands of George McCulloch in view of an action thereanent depending before the Lords of Council and Session. To which it was answered by Patrick that he only insisted against the truants for the crop of 1682 and in time coming which was not included in the action before the Lords. Alexander then protested that the cour ought not to be prejudicial to a pact between the said Patrick McDowell and James McCulloch of Mule anent the multures of Mule, whic paction either by word or writ Patrick denied. Lastly Alexander protested against Patrick being infeft in the sixteenth corn furth of the lands of Evinshanks in respect that the lands were only liable to the [blank] To which Patrick replied that the miln and multures were disponed to him by Gordon for the sixteenth corn out of Evinshanks and he was therefore in bona fide to pursue for the same. And, finally Patrick protested against Alexander acting as procurator seeing that he had not taken the Test conform to Act of Parliament. Done in the house of William Chambers at the myln |
