Contract dated at Wigtone between Wm. McCulloch brother to Robt. McCulloch of Drummorrall styled in the Contract under written, 2nd lawful son of umquhile James McCulloch of Drummorall on one part and Wm. McCulloch of Inshankis on the other part, narrating Contract between umquhile Patrick Hannay of Kirkdaill on one part and said umquhile Jas. McCulloch on the other part of date 23 December 1617 whereby for 1800 merks said umquhile Patrick Hannay bound himself to infeft said umquhile Jas. McCulloch, his heirs &c. heritably in the 4 merkland of Kirkdaill in parish thereof, as warrandice lands in case the lands of Balnab be evicted from him during the non redemption of said lands of Kirkdaill, or in case it should happen the said Patrick Hannay after the decease of umquhile Agnes McKie hismother liferenter of Kirkdaill, to faill in payment of the said sum: and also Contract between said umquhile Jas. McCulloch disponing to Wm. McCulloch, his son, the said 4 merkland of Kirkdaill. Dated 14 January 1623, and constituting said Wm. McCulloch, his assignee, in and to the former Contract and because the said William McCulloch is due to Wm. McCulloch of Inchanks £1000 contained in 4 obligations, therefore he dispones to him in security thereof, the said 4 merkland of Kirkdaill &c.
