GD12/51 Letters of summons under the Great Seal at the instance of John de Swynton of that ilk, Kt, summoning Alexander de Hume, John de Hume, his brother, David Hume of Spot, Hugh Montgomery of Thorntoune, John Montgomery, his son, William Douglas of Quhitingeame, Kt, John Douglas his brother, Archibald Douglas, David Rantoune of Bille, John Ellaine of Buttirden, Thomas Redpeth of that ilk, William Redpeth in Grenlaw, James Ogil, son and heir apparent of Henry Ogil of Popil, Thomas de Edinton of that ilk and Patrick Diess in Mersyntoune, to compear in Edinburgh to answer their error on a breve of inquest procured from Alexander, Duke of Albany, Earl of March and Lord Annandale and Mann by Laurence, lord Oliphant, regarding the lands of Cranschawis lying in the earldom of March and sheriffdom of Berwic, which found the deceased John Oliphant of Aberdalgy, Kt, father of the said Laurence to have died vest and seised of fee in the said lands, whereas the said John of Swynton alleges they were in his hands as true possessor thereof for forty years bypast. George Cunningham of Beltoun, stewart of March is also summoned to compear and answer charge that he held a court of the said stewartry in execution of the said breve within the burgh of Dunbar whereas it should have been held upon the ground of the earldom of March. GD12/52 Letters of summons under the Great Seal at the instance of John de Swyntoune of that ilk, Kt, against George Cunyngham of Beltoune, sometime stewart of the earldom of March in that part, to compear before the King and his councillors at Edinburgh to answer for his alleged unjust and unorderly proceedings against the said Sir John in the execution of a breve of inquest raised by Laurence, lord Oliphant, on his claim to the lands of Cranschawis in the sheriffdom of Berwic, holding a pretended court not within the bounds of his office and acting unlawfully, not having taken his oath to the execution of his office; and for summoning George, abbot of Aberbroch, Robert, abbot of Kalco, Master Gilbert Rerick, archdeacon of Glasgow for the clergy, William, Earl Marischal, Lord Keith, William, Lord Abernethy in Rothimay, and John Lord Dernle, for the barons, and Alexander Haliburtoune, burgess of Edinburgh, Matthew Forstar, burgess of Strivelyn and Alexander Foulis, for the commissioners of burghs, auditors of causes and complaints of last parliament, to answer for their not answering the summons raised by the said Sir John regarding the wrongous process of the foresaid stewart. GD12/54 Letters of summons under the signet at the instance of James of Redpeth, Alexander Redpeth and Johne of Redpeth against Laurence, lord Oliphant, that he caused his officers, Gilbert Nevin and Patrick of Smeithtoune to come to their mailings and tacks within the lands of Cranschawis, debateable between him and Sir John of Swynton of that ilk, Kt, and taking away oxen and horse for their mails, and also that the said Sir John had raised and taken up other double mails upon the said persons, summoning Sir John and the said Gilbert and Patrick to compear and answer upon the double mails. GD12/58 Indenture between Alexander, duke of Albany and Earl of March on the one part, and Lorans, lord Eliphant [Oliphant] on the other part; giving to Lorans, lord Eliphant, all the malis of the lands of Cranschawis lying within the earldom of March for thirty years extending to twenty pounds. Which lands came into the hands of the dukes of Albany following the decease of John Eliphant, father of the said Lorans, in default due to the non entry of the said Lorans to the lands of his father; until the said Lorans purchased breve of inquest directed to the stewart of March for the thirty years' malis extending to twenty pounds, for which the said Lorans will pay to the Duke of Albany thirteen score pounds of the usual money of Scotland to be paid ten pounds termly until the debt is discharged. Failure to pay by 20 days after each term allows Alexander to distrain the lands of Cranschawis at each term for £10; should the lands of Cranschawis be recovered from Lorans by law, the said Alexander discharges the said Lorans of the payment of the said sum, requiring the said Lorans to make every effort to keep the said lands unrecovered; penalty for disposing of the lands without permission of the duke of Albany set at 1000 merks within 40 days; no agreement to be entered into with Sir Johne of Swyntoune nor with any others of his name without special permission of the said duke, and then with payment to the duke of 1000 merks within 40 days; the duke gives Lorans permission to pursue Sir Johne of Swyntoune and his heirs and any others who have taken up malis from the lands of Cranschawis since the decease of Sir Johne Eliphant. 20 Feb 1476/1477 This record is Open.
GD12/59 Extract confirmation under the Great Seal of the act and decreet of the Lords of Council dated at Edinburgh the 25 Oct 1477 at the instance of Johnne of Swyntoun of that ilk, Kt, James of Redpeth, Johnne of Redpeth, Johnne of Liddale and Henry Richardsoun, against Lourence lord Oliphant, Patrik Hamiltoun, Patrik Smethtoun, Johne of Roule, Gilbert Nevinsoune, Androu Creichtoun, Williame Heriot and Master James of Fentoun for the wrongous taking away of 4 horses belonging to the said Sir John and his tenants from the lands of Cranschawis by Patrik Smethtoun for the malis of the said lands on behalf of the duke of Albany, the other accused being found guilty by their presence at the taking of the horses; letters to be directed for the restoration of the horses.
